Agreeing on Divorce-Related Issues

To file an uncontested divorce in Utah, you and your spouse must agree to all of the following:
- Sharing parental responsibilities and custody
- Child support arrangement
- Spousal support (alimony) arrangement
- Property division
- Debt division
As long as both parties agree to the terms, you will not need to go to court. A judge will need to approve the final divorce, which should not be a problem as long as both parties agree. As long as the terms are fair, and one of the parties was not under duress, the judge will finalize the divorce.
Children and Divorce
Children can complicate an uncontested divorce as the divorcing spouses may find themselves struggling to come to terms with a fair agreement. Most people are able to move forward with an uncontested divorce case without the need for an attorney, but it is a wise idea to at least have an attorney review the paperwork prior to having it filed with the court.
