Grounds for Divorce in Utah
Utah is a “no-fault” divorce state, which means both parties can join together in agreement to end the marriage. When one party feels the marriage is over, and the other doesn’t, an “irretrievable breakdown” is commonly cited as the reason for divorce.
No test is required to prove the breakdown is related to irretrievable breakdown, instead one or both parties agree the marriage has no hope of reconciliation.
Divorce Paperwork Requirements
When you are moving with a contested divorce, you need to fill out all the necessary paperwork. A Summons with Notice or Summons and Verified Compliant is filed and copied to the records of the case. The County Clerk’s Office will provide the index number, which is the number assigned to the divorce case and file it.
Once you have followed through with the County Clerk, the next step is to have your spouse sign the Acceptance of Service. Once the paperwork is signed, the court can move forward to focus on setting a court date.
What happens if your spouse won’t sign or won’t return the Acceptance of Service? You will need to have them served the papers along with Child Support Standards Chart if you have children. Once your spouse is served, the court will grant 40 days from the serve date before they will place your court case on the calendar.
