Getting Divorced When You Can’t Locate Your Spouse
There are many reasons why a couple choose to divorce. However, if you find yourself dealing with the end of a marriage, and you are unable to find your spouse, what can you do?
With a traditional divorce case, you will serve your spouse with divorce papers and move forward with the case. If you have made diligent efforts to find your spouse, and you are unable to locate them, you can ask the court for an Order of Notice by Publication.
A notice of publication means you will post a notice in the newspaper near the last known whereabouts of your spouse. The advertisement needs to run for approximately three weeks to give your spouse time to respond to the notice.
If you are unable to find your spouse, you can divorce them without their participation in the proceedings. The judge will determine if enough was done on your part to find your spouse and notify them of the divorce.
